"Funeral Director" shall mean Codfern Pty Ltd ACN 010 869 959 and its associated legal entities, together with their successors and assigns.
"Client" shall mean the Client, or any person acting on behalf of and with the authority of the Client.
"Goods" shall mean the urns and jewellery sold by the Funeral Director from each of its places of business.
"Price" shall mean the sale of the price of the Goods, as agreed between the Funeral Director and the Client.
Any instructions received by the Funeral Director from the Client for the supply of Goods by the Funeral Director shall constitute acceptance by the client of these terms and conditions.
Upon acceptance, these terms and conditions are irrevocable, and may only be varied with the written consent of the Funeral Director.
The Price shall be the Funeral Director's current Price for the Goods, from time-to-time.
At the Funeral Director's discretion, a deposit may be required for the Goods, if delivery of the Goods is not effected at the time of purchase.
Time for payment of the Goods shall be of the essence, and the Funeral Director may withhold delivery of the Goods until the Client has paid for the Goods.
Payment for the Goods shall be by way of cash, a credit card acceptable to the Funeral Director or by EFT.
The Price displayed on the Goods by the Funeral Director includes any GST applicable to the sale of such Goods.
The Goods shall be delivered to the Client upon payment of the Price in full.
The Funeral Director shall not be liable for any loss or damage to the Goods during transit to the Client, if the Goods are delivered by a third party.
The Funeral Director retains all property int he Goods until payment of the Price has been paid in full by the Client and all risk for the Goods passes to the Client upon payment of the Price in full.
The Funeral Director shall not be responsible for any term, condition, representation, or warranty, other than that which is given by the manufacturer of the Goods.
If the Client defaults in pyment of any invoice when due, the Client shall indemnify the Funeral Director against all costs incurred by the Funeral Director in pursuing the debt, including legal costs on a full indemnity basis.
If any part of the Price becomes overdue for payment, the Funeral Director shall be entitled to charge default interest of ten per cent (10%) per annum.
Should any of these terms be unenforceable, the validity of the remaining terms shall not be affected.
The law if the state of Queensland shall apply to these terms and conditions.
The Funeral Director reserves the right to vary these terms and conditions from time-to-time, and to publish a revised set of terms and conditions, which will be displayed on the Funeral Director's website.
